These Terms & Booking Conditions apply to every expression of interest, booking and attendance at a Stunt Driving Clinic, operated by Cody Inc. Action Design ("SDC", "we", "us" or "our"). Please read them carefully — by enrolling in or attending a clinic, you agree to them.
Stunt driving is a physical, high-performance activity carried out in and around motor vehicles. It carries inherent risks. These terms explain the responsibilities that come with taking part.
On this page
1. Acceptance
By submitting an expression of interest, paying for a clinic, or attending a clinic, you confirm that you have read, understood and agreed to these Terms & Booking Conditions. If you do not agree, please do not enrol or attend.
2. Eligibility
Our clinics are designed for stunt trainees and stunt professionals working in film and television. To take part, you must:
- Be at least 18 years of age
- Hold a current, valid driver's licence where required for the activity
- Provide accurate union membership and grading information where requested
- Be in a physical condition suitable to safely undertake driving activities, and disclose any relevant medical condition or injury before attending
We may decline or cancel an enrolment where eligibility, safety or suitability requirements are not met.
3. Expressions of interest & enrolment
Submitting the Expression of Interest form registers your interest in a clinic. It is not a confirmed booking. A place is only confirmed once we have contacted you, offered you a place, and your payment has been received (where a fee applies). We will confirm final details, including date, time and venue, before the clinic.
4. Fees & payment
Clinic fees are as advised to you at the time of booking. Payments are processed securely by Square. Your place is not guaranteed until payment is received. All fees are in Australian dollars unless stated otherwise, and you are responsible for your own travel, accommodation and incidental costs.
5. Dates, venue & changes
Our clinics depend on venue availability and minimum student numbers. As noted on our enrolment form, dates and availability are subject to change. We may reschedule, relocate or cancel a clinic where necessary — for example due to venue access, weather, safety, insufficient numbers, or circumstances beyond our control. Where we make a significant change, we will let you know as soon as reasonably possible and offer you an alternative date or a refund of fees paid for that clinic.
6. Cancellations & refunds
If you cancel
If you need to cancel or transfer your place, contact us as early as possible. Refund and transfer arrangements will be as advised at the time of booking. Late cancellations or non-attendance may not be refundable, as your place and resources have been reserved for you.
If we cancel
If we cancel a clinic and cannot offer you a suitable alternative date, we will refund the fees you have paid for that clinic. We are not responsible for any travel, accommodation or other costs you may have incurred.
Nothing in this section limits any rights you have that cannot be excluded under the Australian Consumer Law (see section 10).
7. Conduct & safety
Because our clinics involve motor vehicles and physical activity, your cooperation with safety directions is essential. While attending, you must:
- Follow all instructions and safety directions given by our instructors and venue staff at all times
- Not attend or take part while affected by alcohol or drugs
- Wear any protective equipment provided or required, and drive only as directed
- Operate vehicles and equipment responsibly and only when authorised to do so
- Disclose any medical condition, injury or medication that may affect your ability to take part safely
- Treat other participants, instructors, staff and the venue and vehicles with respect and care
We may remove any participant from a clinic, without refund, where their conduct is unsafe, disruptive or in breach of these terms.
8. Assumption of risk
You acknowledge that stunt and performance driving is an inherently dangerous recreational and professional activity that involves real and significant risks, including the risk of vehicle collision, loss of control, mechanical failure, personal injury, disability, property damage and, in rare cases, death. You take part voluntarily and accept the inherent risks of the activity. This clause is intended to operate as a risk warning for the purposes of applicable consumer and civil liability laws.
Waiver signed on the day. Before taking part in any track day, you will be required to sign a liability waiver on the day, at the venue. You will not be able to participate until this waiver is signed.
Optional personal insurance. We arrange a Racers Insurance package for each track day. When you sign your waiver on the day, you will have the option to sign up, for an additional cost, to optional cover under that package that insures you personally for the day. This cover is arranged and handled directly through Racers.
9. Liability
To the maximum extent permitted by law, and subject to section 10, SDC and Cody Inc. Action Design, together with our instructors, staff and venue partners, are not liable for any loss, damage or injury arising from your participation in a clinic, from the inherent risks of the activity, or from your failure to follow safety directions. You are responsible for any loss or damage you cause to vehicles, equipment, property or other people through your own reckless or negligent conduct.
10. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, that applies to you under the Australian Consumer Law and cannot lawfully be excluded. Where our liability can be limited by law, it is limited to resupplying the relevant service or paying the cost of having it resupplied.
11. Photography & media
We may photograph or film clinics for training, promotional and marketing purposes. By attending, you agree that we may capture and use images or footage that include you, including on our website, social media and advertising. If you do not want to appear in this material, please tell us in writing before the clinic and we will take reasonable steps to accommodate your request. See also our review and testimonial terms in the Privacy Policy.
12. Course material
All course content, techniques, written material and resources provided during a clinic remain our intellectual property. They are provided for your own professional development and may not be copied, recorded, redistributed or taught to others commercially without our written permission.
13. Privacy
We handle your personal information in accordance with our Privacy Policy, which forms part of these terms.
14. Governing law
These terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
15. Changes to these terms
We may update these Terms & Booking Conditions from time to time. The version in force is the one published on this page at the date of your booking, shown by the "Last updated" date at the top.
